5 Critical Lessons About Spec Scripts - Screenwriting Goldmine

I?m currently deep into reading the entries for our screenplay contest, and certain patterns are emerging.

I thought I?d try and pass them on?

1. All Black Screen Openings Are Tired

Opening your script with a black screen and a voice over really has to stop. It?s not a big deal for me, and I?ll ignore the fact you?ve done it, but trust me, it?s not quite as fresh an idea as you might believe.

In fact it?s a MASSIVELY over-used device right now?!

2. Speaking of Fresh?

Original story setups, that you genuinely haven?t seen before, really do stand out.

I?m much more eager to read a script about a world I?ve never been to before than yet another dour police procedural.

Good writing is good writing and will come out on top in the end, but it?s worth remembering next time, that fresh, original story worlds and story angles DO initially get a slightly favourable read.

3. The Standard is Really, Really GOOD!

All these years of all those screenwriting books out there, all these workshops, all these forums dedicated to spreading basic technique, they?re all paying off. The average script I?m reading is far, far better than it was fifteen years ago.

The downside of that for you, trying to get yourself noticed, is that the bar has been raised considerably. When most scripts have a basic story structure fairly well in place you as a new writer simply cannot afford to be unaware of all that sort of thing.

Even if you reject the traditional three act paradigm in favour of your own personal invention, comprising, I don?t know, 7 and a ? phases plus a coda, you have to do it from a position of strength.

If you?re into traditional three act structure you have to be really on it. You have to know what you are doing, you have to hit the beats lightly, cleverly, and preferably subversively in some way.

If you?re NOT going to do this then you have the even harder job of making the story form you are using shine with conviction, precision, and the genuine knowledge of why more traditional story telling doesn?t work for you.

4. It?s Not Enough to Have a Good Structure

I?ve got a number of scripts on the slate now where I love the set up, I love the structure, but the dialogue is heavy handed.

Remember, I?m not looking for scripts in which I can see promise ? far too many of them show promise. With just five finalist spots I?m looking for scripts that are as near dazzling as possible. So your dialogue has to simply spark along. Subtext, economy, precision, occasional humour, credibility, are all crucial.

5. You Need a Voice

It?s not even enough to have a good structure, good setup, good characters and good dialogue. I?m looking for scripts that have all that ? but also have that rarest thing: a wild, never before heard voice.

This is the advanced stage. This is the point at which you have mastered all the elements so well that your unique way of seeing the world combines with your unique writing style and your mastery of the story telling elements to elevate your script into something that burns into the imagination, is satisfying, surprising, entertaining ? even haunting.

You get to this point by reading, and reading, and watching, and breaking down, and being brave enough to cut lose and reach deep into yourself and bring whatever you?ve got out to be shaped by your well-developed craft.

This is something that I think can never be taught, that comes with experience, with passion, with a genuinely original way of seeing the world.

I?m lucky enough that I?m not looking for scripts that will play well on a particular TV channel, that will hit a specific audience demographic in the theatres ? I?m simply looking for scripts that have both great craft and a strong voice, whatever the genre, whatever the ambition.

It?s a tribute to you all that there are more than a few scripts like this among the entries I?ve read so far.

To learn the elements of screenplay structure, go here.

To learn about great dialogue, and how best to read and break down some scripts that do shine with inner life, go here.

ANOTHER WRITERS GUILD TRIUMPH

The Writers Guild of Great Britain has negotiated the best new digital and on-line agreement for writers anywhere in the world.

All new commissions are now under these new terms, and all scripts commissioned under the previous agreement since November 2002 automatically switch over to the new terms.

WILL MY IDEA GET STOLEN?

Normally I say don?t worry about it, that such questions are the mark of the amateur, that ideas are your currency, and if you?ve only got one that you guard so jealously then you?re not going to get anywhere, that ideas themselves are cheap it?s the implementation of them that counts?.

All those points I do still believe.

But there is also this.

FINAL DRAFT APP

It?s finally out, in iTunes, for a rather eye-watering $29.99.

My own opinion is that I need a huge heavy keyboard to write anything, so I won?t be buying, but a rather less ludditical (sp?) opinion from writers I know is that if you like Final Draft, and you have an iPad, then you?ll like this app.

FROM THE FORUMS

Here are some discussions from the Goldmine forum:

How do you reveal names to the reader when they haven?t been revealed in the story so far..?

What can and can?t you do in a spec script?

The legal implications of using real life characters in fiction.

What is a ?treatment? and what is it for?

Should you promote negative (in this case anti-christian) ideas in your script?

Paramount and 'Godfather' author heirs clash in NY - NewsOn6.com ...

By LARRY NEUMEISTER
Associated Press

NEW YORK (AP) - The dispute over the future of "The Godfather" franchise is moving to federal court in Manhattan as Paramount Pictures and heirs of the story's author face off at a hearing Thursday.

The son of "The Godfather" creator Mario Puzo wants a judge to end Paramount's rights to make future "Godfather" films.

Lawyers for Anthony Puzo said in court papers that the company breached its contract when it tried in December to stop publication of "The Family Corleone," a "Godfather" sequel that was published in May.

Paramount, which is owned by Viacom Inc., sued the late author's estate in March, seeking a declaration that it automatically owned book publishing rights in any book that was a sequel to "The Godfather." Paramount said in court papers that in 1969, it purchased from Puzo all rights and copyright interests in "The Godfather," including all "literary" rights and rights to use any characters created for the story in "other works." Mario Puzo died in 1999.

Paramount said the only right left to the Puzo estate was the right to publish the original novel "The Godfather" and to publish versions and adaptations.

But the estate's lawyers disagree. They said the agreement excluded book publication rights from the rights that Paramount could acquire.

They said Paramount also got nasty in trying to prevent publication of the new sequel by contacting the publishers of the book and insisting that neither the publishers nor the estate had any right to publish it.

The estate asked the court to declare that the estate owns the book publishing rights to any sequel, that Paramount cannot prevent the estate from publishing the book and that Paramount does not automatically have film rights to new books.

"The rights repudiated and violated by Paramount were of fundamental and critical importance to Puzo and were of the essence of the 1969 agreement," the lawyers wrote. "More than once, Puzo said, 'Books are my world,'" explaining why Paramount didn't get book rights and wouldn't get them."

(AP) ? Laura Robson dissolved into giggles at a reference to British boy band One Direction.

Yes, she's definitely 18. She also has beaten two former Grand Slam champions at the U.S. Open, and will face another in her next match.

The British teen beat 2011 French Open winner Li Na in the third round Friday, two days after she ended the career of four-time major champ Kim Clijsters. Next up: Sam Stosur, who happens to be the defending champion.

"I have had a fairly tough draw, haven't I?" Robson said with the smile of a player racking up confidence.

Ranked 89th, Robson had never been past the second round of a major tournament or knocked off a top 10 opponent before this year's Open. Now she's done both, after eliminating the ninth-seeded Li 6-4, 6-7 (5), 6-2.

Robson put her hands to her head in I-can't-believe-this joy after the Chinese star returned her serve long on the final point.

"I have had lots of tough matches against some very experienced opponents, so the way that I see it, it was time to start winning a few of them," Robson said.

Stretching before the match, Robson noticed a tweet from English soccer star Wayne Rooney wishing her luck. Except he called her "Laura Robinson." Rooney later faulted predictive text for the gaffe, which didn't seem to dent Robson's self-assurance.

"Can you blame that on predictive text, though?" she joked. "I'm not so sure."

Following her from the stands Friday was British actor James Corden.

"I spotted him midway, like, first set, and then spent the rest of the time trying not to wave," Robson said.

She also showed poise after failing to close out the match in the second-set tiebreaker, then overcoming two incorrect calls in the third set where she had to replay points she would've won if the initial ruling had been right.

With a break point on Li's serve at 2-2 in the final set, Robson's return clipped the baseline and Li hit the ball wide. But the line judge called Robson's shot out and, after a review overturned it, Robson lost the replayed point. Li won the next point as well to earn game point. But with the Louis Armstrong Stadium crowd roaring its support, Robson rallied back to get the break.

"I was a little bit annoyed. But that's what happens from time to time, so you've got to deal with it," she said. "I think being a little bit annoyed seemed to help me, seeing as I broke the first game then I held serve the next time it happened."

On Wednesday, Robson ended Clijsters' career, winning both sets in tiebreakers in the second round against the 23rd-seeded Belgian. Robson's career might now be really getting started.

She became the next great British hope when she captured the 2008 Wimbledon girls' title at age 14. Four years later, injury-free for the first time in a while, she seems to be reaching that potential, the youngest woman ranked in the top 100.

"I'm only 18, so if I was that negative a year ago, then who knows what I'm going to be like in a few years," Robson said, referring to whether she ever doubted her future. "But, no, I have always thought that I can play with the top girls. Whenever I've practiced with, you know, Caroline or Maria, I've always felt that the level was there. It was just taking that onto the match court and keeping the level up for the whole match."

And she became the first British woman to make the fourth round at a Grand Slam event since Sam Smith at Wimbledon in 1998. Robson had 27 unforced errors to 34 by the 30-year-old Li.

"I was making a lot of mistakes in my whole match, so of course give a lot of free points to her," Li said. "Made her like, 'Oh, I got more confidence. Oh, I can beat her.' "

The seventh-seeded Stosur was pushed for the first time in this year's Open by No. 31 seed American Varvara Lepchenko, but dominated the second set after winning the first in a tiebreaker for a 7-6 (5), 6-2 victory.

Stosur has never faced Robson ? or really watched her play for long.

"She's obviously full of confidence and had two very, very good wins," Stosur said.

Four-time major champ Maria Sharapova, the No. 3 seed, ended the surprise run of Stanford All-American Mallory Burdette, needing 58 minutes to win 6-1, 6-1. Fifth-seeded Petra Kvitova, the 2011 Wimbledon champ, also advanced.

Friday night could be the farewell for 2003 champion Andy Roddick. A day earlier, he announced this would be the final tournament of his career.

The American is set to face Bernard Tomic in Arthur Ashe Stadium.

In earlier men's action, defending champ Novak Djokovic beat 112th-ranked Rogerio Dutra Silva of Brazil 6-2, 6-1, 6-2. Djokovic didn't face any break points in winning in 1 hour, 39 minutes. Two other former champs also advanced: Juan Martin del Potro and Lleyton Hewitt.

Fourth-seeded David Ferrer won his first two sets in 62 minutes, then needed 65 minutes to clinch the third set in a tiebreaker that went 26 points. The Spaniard beat Igor Sijsling 6-2, 6-3, 7-6 (12) in the second round.

NCAA champ Steve Johnson, who had played in just one Grand Slam match before this year's Open, reached the third round with a four-set win over No. 145-ranked Ernests Gulbis.

The 22-year-old Johnson, ranked No. 245, went undefeated this season for Southern California to win his second straight NCAA title and earn a wild card into the Open.

No-till farming helps capture snow and soil water

A smooth blanket of snow in the winter can help boost dryland crop productivity in the summer, and no-till management is one way to ensure that blanket coverage, according to U.S. Department of Agriculture (USDA) research.

Agricultural Research Service (ARS) soil scientist David Huggins conducted studies to determine how standing crop residues affect snow accumulation and soil water levels across entire fields. ARS is USDA's chief intramural scientific research agency, and this work supports the USDA priority of responding to climate change.

Huggins, who works at the ARS Land Management and Water Conservation Research Unit in Pullman, Wash., carried out this investigation on two neighboring farms. Both farms have the hilly topography typical of the Palouse region in eastern Washington. But much of one farm has been under continuous no-till management since 1999, while the fields on the other farm were conventionally tilled.

For two years, snow depths, density and soil water storage were measured manually at hundreds of points across the fields on both farms. Residue height at data collection points was also measured on the no-till fields.

Huggins found that standing wheat residue on the no-till farm significantly increased the amount and uniformity of snow cover across the entire field. Snow depths on the no-till field ranged from 4 to 39 inches, with an average depth of 11 inches, while snow depths on the conventionally tilled field ranged from 0 to 56 inches, with an average depth of 8.5 inches.

The snow distribution pattern on the no-till farm made soil water distribution more uniform and increased soil water recharge rates there. The more uniform snow distribution under no-till was particularly apparent for ridge tops and steep south-facing slopes where there was typically 4 to 8 inches more snow than on conventionally tilled fields.

Huggins calculated that the greater storage of soil water in no-till systems could increase winter wheat yield potential by 13 bushels per acre on ridge tops, six bushels per acre on south facing slopes, and three bushels per acre in valleys. As a result, regional farmers could increase their winter wheat profits by an average of $30 per acre and as much as $54 per ridge-top acre.

Producers affected by the 2012 drought might also benefit from using no-till to increase the amount and uniformity of snow cover on their fields. This would increase soil water recharge rates and soil moisture storage, which would facilitate the return of drought-stricken fields to their former productivity.

Results from this work were published in 2011 in Transactions of the ASABE.

'Nano machine shop' shapes nanowires, ultrathin films

ScienceDaily (Aug. 29, 2012) ? A new "nano machine shop" that shapes nanowires and ultrathin films could represent a future manufacturing method for tiny structures with potentially revolutionary properties.

The structures might be tuned for applications ranging from high-speed electronics to solar cells and also may have greater strength and unusual traits such as ultrahigh magnetism and "plasmonic resonance," which could lead to improved optics, computers and electronics.

The researchers used their technique to stamp nano- and microgears; form tiny circular shapes out of a material called graphene, an ultrathin sheet of carbon that holds promise for advanced technologies; and change the shape of silver nanowires, said Gary Cheng, an associate professor of industrial engineering at Purdue University.

"We do this shaping at room temperature and atmospheric pressure, like a nano-machine shop," said Cheng, who is working with doctoral students Ji Li, Yiliang Liao, Ting-Fung Chung and Sergey Suslov and physics professor Yong P. Chen.

Graphene and nanowires -- filaments 1,000 times thinner than a human hair -- have numerous potential applications. However, technologies are needed to tailor them for specific uses. The new method, called laser shock-induced shaping, makes it possible to tune nanowires by altering electrical and optoelectrical properties that are critical for electronic components.

The researchers also have shown how laser shock-induced shaping can be used to change the properties of graphene, a step toward harnessing the material for electronic applications.

Findings were detailed in research papers published in the journal Nano Letters, and the work also was highlighted earlier this month in the News and Views section of the journal Nature Photonics.

The technique works by using a multilayered sandwich structure that has a tiny mold at the bottom. Nanowires were situated directly above the mold, and other materials were layered between the nanowires and a glass cover sheet. Exposing this layered "forming unit" to an ultra-fast pulsing laser causes one of the layers to burn up, generating a downward pressure that forces the nanowires into the mold and changes their shape.

"The process could be scaled up for an industrial roll-to-roll manufacturing process by changing laser beam size and scanning speed," Cheng said. "The laser shock-induced shaping approach is fast and low-cost."

Part of the research, funded by the National Science Foundation, was carried out in a specialized clean room at the Birck Nanotechnology Center in Purdue's Discovery Park.

Sex and Relationships With Mikaya Heart: Exercise, Sports, and Sex ...

I recently heard about someone who had orgasms when she was doing sit-ups. Presumably she uses her PC muscles when she is doing sit-ups, and the PC muscle in turn stimulates the tissues of the clitoris, since it?s all in the same area. She would also have to be willing to allow the sensation of orgasm to occur in that situation; many of us would suppress it before it reached fruition, perhaps before we were even aware of the possibility of coming. In any case, exercising regularly will help you to get in tune with your body, which is an essential aspect of having good sex, because your body knows what it needs and wants, and when you have an orgasm you must trust your body enough to let it take over.

Some sports can be ecstatic and refreshing in a similar way to having an orgasm. My sport of choice is kitesurfing, which is an exquisite dance with water and wind. The movements that I am making to enable myself to stay on the board are so constant and minute that they are far beyond the ability of the rational brain. They are a body memory, and when I am out there, I must be absolutely focused and present, allowing my body to do what it needs to do without interference from the rational brain. I always return to shore feeling re-vitalized and renewed. Does this sound anything like sex?

I assume that most extreme sports, such as mountain climbing and car racing, have a similar effect, but other sports such as running and biking can certainly improve your sex life, especially if you share them with your partner. You may find that exercise of any kind enhances your intimacy and gets you both in the mood for sex simply because it is a way of tuning into the body and raising your energy levels ? which are then looking for the kind of release that sex can provide.

Toned PC muscles can prevent urinary incontinence as well as enhance your sexual responses quite dramatically in some cases. You can identify them by stopping your pee in mid flow. Then, when you are sitting at work, in a traffic jam, or waiting in line at the bank, practice contracting and relaxing those muscles. It?s worth the minimal effort it takes, but remember that relaxing them is as important as strengthening them, because chronic tension in the genital area can cause sexual problems. Women who have difficulty relaxing the PC muscle may often have emotional issues to deal with. Don?t think there is something wrong with you if that?s your situation; it?s usually to do with bad experiences or simply growing up around people who are uptight about sex, which, sadly, includes a large percentage of people in the world. The good news is that it?s always possible to work through those issues. You may need to find a good understanding therapist who can work with you.

Emerging Market Small Caps: The Best Stocks For - Investment U

by Jason Jenkins, Investment U Research
Tuesday, August 28, 2012

In this age of endless information and media exposure, we get overwhelmed by reports and studies from all types of organizations and statistics referred to only by some crazy acronym ?the IMF, ECB, PMI? The list goes on.

Believe it or not though, some of these reports and organizations actually give us good stuff. And acting on the right information can help build wealth. One such came report came out about two weeks ago and what it said could weigh in on your portfolio choices for some period of time.

You may have seen news referring to the OECD acronym sometime around the second week of August. The Organization for Economic Co-operation and Development (OECD) is a global economic organization of 34 countries founded in the early 1960s with a stated mission ?to stimulate economic progress and world trade.?

The OECD over the last decade has been attempting to define and separate itself from all those other international acronyms. They seem less concerned with the theories of international macroeconomics or lending money to debt ridden countries. They try to get down to the ?nitty gritty? and talk about agricultural and/or educational reform. As one former Secretary General stated, they would rather be ?a steering group for the world economy.?

What does this mean for you? In a nutshell, the OECD has some great international economic stats. More importantly, they have been pretty reliable in predicting economic trends.

The OECD Sees a Slowdown Ahead

According to the OECD?s composite leading indicators (CLIs) of economic activity, most of the developed economies are probably going to slow. These indicators are set up to give early signals of turning points between times of boom and bust. Here are how they?re made up:

? You have ?early stage? indicators which look at what?s going on in the initial stages of production like construction approvals

? Then you have ?rapidly responsive? indicators which respond in a timely manner to changes in the economic landscape. An example would be stock market indices.

? ?Expectation-sensitive? indicators would reflect qualitative reports and measures like consumer confidence.

? Finally, ?prime movers? indicators are related to monetary policy and foreign trade

The OECD reported August 8 that its leading indicator fell to 100.3 in June from 100.4 in May. This leads us to believe that there will be ?an easing of economic activity.?

oecd indicator chart

What Does it Mean to Me?

The OECD?s findings haven?t put the world on its head because we?ve pretty much known this information for quite some time. What it does, however, is give more credibility to what we thought we knew.

In response, there has been a move lately for investors and some fund managers to take a longer look at emerging-market stocks. They are looking more specifically at stocks that are tied to their own domestic consumer growth. The object of this strategy is to take advantage of emerging market growth that isn?t too highly dependent upon demand from Europe and other developed declining economies.

According to Roger Edgley, lead manager of Wasatch Emerging Markets Small Cap Fund (WAEMX), Small-caps in emerging markets ?are less risky than large caps and have less exposure to the developed markets? Developed markets have actually gotten riskier, if you look at debt to GDP, bank stress, and fiscal stress.?

Edgley likes companies with consistent growth over time and here are five of his favorites in WAEMX:

? Colgate-Palmolive India Ltd. (BOM:500830) is a separately traded unit of well recognized Colgate-Palmolive and it is taking advantage of a blossoming domestic consumer market in India.

? LIC Housing Finance Ltd. (BOM:500253) is a part of India?s largest insurer. It provides loans for purchase, construction, repairs and renovation of houses to individuals, corporations, builders and co-operative housing societies.

? Cleanaway Co. Ltd. (TPE: TW:8422) would fall into Warren Buffett?s ?Moat Strategy?. It?s a Taiwanese hazardous waste treatment and management company and this industry has high barriers to entry.

? Discovery Holdings Ltd. (ZA:DSY) is a leading insurer in South Africa which provides insurance products and financial services to employer groups and individuals. They have a range from South Africa to Great Britain China, and the U.S?

? Dah Chong Hong Holdings Ltd. (HKG: HK:1828) is a is a Hong Kong-based conglomerate that deals in motor vehicle sales and repair, air cargo equipment distribution, cosmetic, airport ground support equipment maintenance, food, logistics and warehouse services. Edgely believes that the company can grow even under the threat of a further global meltdown.

If you don?t want to invest individually or can?t invest in foreign stocks with your broker, the Wasatch Emerging Markets Small Cap as of about a week ago is up nearly 15% for 2012. Morningstar also puts it in its top 2% of its Diversified Emerging Markets class. If you look at the annualized return for the last three years, WAEMX is up about 21%.

But this is just one way to hedge against economic slowdowns in the ?developed? world. Stay tuned for more quality emerging market plays from our experts in the weeks ahead.

Good Investing,

Jason Jenkins

Rodrigo Gimenez Grills Up for Open House at Doug Margerum?s New?Winery

    Tuesday, August 28, 2012

When Rodrigo Gimenez was crowned amateur champ of this paper?s Sizzling Summer BBQ Contest in June, the Argentinean architect planned to go back to the drafting board as soon as his work visa came through. That finally happened this month, but instead of designing buildings, Gimenez is sticking to the grill, planning to become a professional chef while putting his architecture career on?hold.

?This is my passion,? said Gimenez, whose first big gig is this Sunday?s open house for the brand-new winery facility of veteran vintner/respected restaurateur Doug Margerum. ?I love to eat and drink and talk with?people.?

    Rodrigo Gimenez?s Argentine Asado?Sampler.

Margerum first tasted Gimenez?s food while judging the June contest and knew it would be a good fit for the afternoon?s ?high-quality, rarely seen? Margerum Wine Company, Happy Canyon Vineyard, and Cent?Anni wines. ?Their fruitiness and structure will complement the wide range of flavors Rodrigo is planning to create,? said Margerum, who?s consolidating all of his operations under one roof in one of the warehouses on Industrial Way in Buellton and noted that a few growlers from Figueroa Mountain Brewing next door might also make an?appearance.

    Gimenez?s mouth-watering menu includes corn pudding empanadas; veggies grilled in a steel disc; burnt tomato, goat cheese, and anchovy crostinis; chicken milanese with smashed?potatoes;

grilled sirloin caps with variety of chimichurris; blood, chicken, and chorizo sausages; sweetbreads in green sauce; and pork ribs in lemon cream sauce. All of it will be grilled over an open flame in a barbecue that Gimenez is building on-site out of cinder blocks. ?The main idea is to cook with fire,? he explained. ?That?s how we do it in?Argentina.?

Though he?ll always have architecture as a fallback, Gimenez is dreaming of much bigger food ideas for the future. ?It?s an amazing opportunity and possibility to start doing this,? said Gimenez. ?Thanks to the newspaper, this could be my new?job.?

Rodrigo Gimenez heats up the grill for Margerum Wine Company?s open house on Industrial Way in Buellton this Sunday, September 2, 1-4 p.m., with wine, food, and winery tours with barrel tastings for $30. beIN Sport USA soccer channel comes to Comcast, DirecTV and Dish Network

beIN Sport USA soccer channel adds Comcast, along with DirecTV and Dish, to list of carriers

While most of us have spent the last few weeks preparing for the return of North American-style football (get our NFL Pick 'Em league info here), soccer fans in the US and France have been tracking the sudden rise of international TV network beIN Sport. Operated out of Qatar by Al Jazeera, beIN Sport USA has snagged the exclusive broadcast rights to Spain's La Liga, Italy's Serie A, France's Ligue 1, South American World Cup Qualifiers and Copa America 2015, plus the away games for the US national men's team in their qualifying rounds. The bad news for those interested in viewing the games is that until just recently, there were no carriers for the channel, although DirecTV (which also recently added BBC America HD for Doctor Who fans) and Dish have subsequently added it to a few tiers. Most recently, Comcast announced the channel's availability on its Spanish MultiLatino package and for English viewers on the Xfinity TV Sports Entertainment lineup, with access also available via internet streaming. It appears Fox and ESPN have a new challenger at least for broadcast rights to soccer, and beIN Sport has expressed interest into other arenas as well, which could see it become a newer version of the now-defunct Worldsport HD channel for fans of sports that are more popular outside the US.

Police: Empire State shooter was losing his apartment

    Louis Lanzano / AP

Police lean over a sheet-covered body as they investigate a shooting outside the Empire State Building on Friday.

    By NBCNewyork.com and news services

NEW YORK -- The man who shot and killed a former co-worker before being killed by police near the Empire State Building was being booted out of his apartment, a law enforcement official says.

Jeffrey Johnson, 58, an out-of-work accessories designer, killed Steve Ercolino, with whom he had been feuding, on Friday in midtown Manhattan. Nine bystanders were wounded as the result of police gunfire, three hit by bullets and six injured by ricocheted fragments.

A law enforcement official told NBC New York on Sunday that Johnson was subletting the Upper East Side apartment where he lived. The owner wanted to do renovations and asked Johnson to move out.?? Johnson had a couple of weeks left until he had to go.? That added pressure may have helped put him over the edge, the source said.

A police source told Reuters that Johnson left his keys with his landlord on Friday to allow renovation of his apartment and apparently intended to never return.

?He left the keys in an envelope for the landlord with no intention of ever coming back,'' said the source.

Detectives searching Johnson's apartment found books on training and fighting skills such as "Techniques and Equipment of the Deadly Marksmen Snipers'' and `"Attack Proof - the Ultimate Guide to Personal Protection,'' the source told Reuters.

They also found a plastic case with 15 rounds of .45 caliber ammunition, the same kind he used to shoot Ercolino, and police planned to examine the contents of Johnson's home computer for more clues to his motive, the source said.

    NBCNewYork.com: Construction worker followed shooter

Johnson had been laid off a year ago from Hazan Imports, across the street from the Empire State Building, where he was locked in a dispute with the victim, police said. Johnson claimed Ercolino had failed to sell enough of his creations and held a grudge, police said.

Johnson and Ercolino filed complaints about each other with police in April 2011, police said.

    Louis Lanzano / AP

A disgruntled ex-employee opened fire Friday morning near his old workplace in New York City, killing one. The gunman was then shot and killed at the scene.

NYT:?After police bullets hit bystanders, questions about protocol?

Ercolino, 41, was a salesman at Hazan. He lived with his girlfriend in Hoboken, N.J.

Ercolino died of multiple gunshot wounds to the head.? He was shot five times in the head and face, according to the medical examiner. He also had a superficial wound to chest that may have been result of a ricochet of one of the shots to the head.

Why your internet connection is on snail speed- Opinion|nation.co.ke

When your computer or the phone is new, the router or modem is new, but your internet connection is slow, you get really frustrated and probably annoyed. The question in your mind must be; if everything is alright, why is Internet running slow?

The reasons can be many, even though we might be unaware of them all. So, let?s find out the probable reasons behind this.

If you are pondering why your Internet is running slow on Windows 7, Vista or any other operating system, then virus attack is a very genuine reason. The Internet gives a poor performance when attacked by viruses and spyware.

When a virus attacks your computer, it multiplies quickly through e-mails, reducing the Internet speed and the computing power at once.

If your computer doesn?t have an up-to-date antivirus, then your system is bound to run slow. Similar is the case with spyware and malware.

These are some computer woes that interfere with the performance of your browser. Spyware are difficult to detect and they will keep on ?spying? your computer files without your knowledge.

If you are using a router, you can probably speed up Internet by adjusting the router settings. There are too many routers to give specific advice, but most routers can be tweaked to open up ports and boost your Internet speed.

Just check the manual for things that can be done to improve performance or use Google to find answers for your particular router.

Before you do any tweaking, check whether you are close enough to the router when you use the Internet. Wireless is liberating, but the trade-off is signal interference ? especially when it?s travelling through walls ? and reduced overall performance.

Being too far away from it can make the connection really slow and unstable.

Another thing you should try before changing any settings is to restart your router. Sometimes this simple action can dramatically speed up your Internet connection.

Most people still use Internet Explorer, even though it?s not the fastest browser out there. If you are an active Internet user, it would be a good idea to check out different browsers, like Chrome, Firefox, and Opera to see which one works best for your connection type and your hardware configuration.

Whereas Internet Explorer is a decent browser, it does also use a lot of resources. Moreover, as web pages get more advanced, the number of processes necessary to load them grows, meaning you?re usually better off with a browser that can be customised to cut back on non-essentials.

Google Chrome, while new, uses very little memory. Safari is usually the fastest way to go for Mac users.

Note that an older computer may not have the power to make use of many things on the Internet now. If your computer is slow, it doesn?t matter how fast your Internet connection is ? everything will be slow because your computer just can?t cope.

The answer to that is to keep your computer in good shape and perform regular maintenance like disk cleanup and defrag, registry repair, and other tasks like monitoring your start-up items and optimising Windows services.

There are many applications that will use your bandwidth in the background, like Windows Update, Windows Live Messenger, Skype, Real player, Adobe Reader updates, and other similar software.

Most of them usually start automatically when you log on to Windows and connect to the Internet as soon as there is a connection. This means that these programmes use your bandwidth when you are not actually using them.

Usher Wins Custody Battle Over His Two Sons

After almost two years of being in a heated custody battle with his ex-wife Tameka Raymond, Usher has something to celebrate. The singer was awarded primary custody of his two sons with Tameka. It is something you don?t see very often, a father being granted primary custody of his children. However in the case of Usher it is a reality and music to his ears. A judge ruled that the singer will be the be the primary care taker for Usher Raymond V age 4, and Naviyd Ely Raymond age 3.?The new arrangement will officially begin on September 1st. An Atlanta judge made the decision on Friday that also gave Tameka visitation rights to the boys. Details of her visitation have not been shared with the public. Losing the custody battle with Usher is yet another blow to Tameka who lost her 11 year old son last month after he was injured in a boating accident. Kile Glover was eventually declared brain dead and taken off life support. During that tragic time although there were reports Usher was there for his ex it was still a very unpleasant time between the former spouses. Tameka had some harsh words for Usher [...]

How do I end the twin soul separation and struggle phase?

Even though you have met your twin soul, there are no guarantees that everything will work smoothly from that day on. (Luckily, there?s also no guarantees that it won?t!) The separation phase is often explained by karmic debt, but we have a different idea on that. This post applies to both twin souls who have already met and those who haven?t met yet.

The old school new age teaches that to make it possible for twin soul couples to be together, they have to be free of all karma. That is a troublesome concept for two reasons. One has to do with non-automatic reincarnation which makes karma unnecessary, secondly, and more importantly, if you look at twin soul couples who are happily together? Do we trust all of them have ?made good? all their bad deeds? I can?t even begin to imagine the amount of bad karma the normal smugness of having found your twin soul the thinking pattern ?this is the reward for my good deeds and high soul age level? would rake up. Your twin soul isn?t a reward for good behaviour or ?enlightenment?, you better get away from that thinking because it?s simply not healthy. If you understand karma in the context that you don?t exactly have to do anything to clear it, but just ?live it through? this makes you sit and wait for some indefinite time frame until you feel it?s right? Or not.

What happens has everything to do with psychology and the law of attraction. If you understand the basis of the law of the attraction, in short, in this context, it can be summed up as ?you get what you believe you deserve?. If deep down you think that you don?t deserve to be loved, the settling karma -thinking would allow you to get around it by ?I have now suffered enough to deserve happiness in the end.? Your time would be better spent on self-improvement, self-empowerment, and clearing your mind from defeating attitudes and negativity. You don?t need to do this in the context of twin souls, but any normal psychologist will be able to help you here. If you are not that way inclined, any life coaching resource might help you, self-help books and simple self-reflection as to what are the reasons that you feel your twin soul doesn?t, can?t or won?t love you, or why you can?t find him in the first place. (It sounds like a different thing if you have met your twin or not but both situations are related. If you haven?t met your twin soul yet, it?s simply because you believe things like this don?t happen to people like you.)

?Get ready for love? does sound a lot simpler than ?align myself with my twin soul? doesn?t it? When you think about it this way, you may have a bit of a chuckle. We do like to mystify things, don?t we? :p The truth is that the twin soul relationship is mysterious and complicated enough as it is, we don?t need to complicate it further. I believe the mystification comes from the need to explain to others that ?my love is bigger than your love?, and although all of us know the difference when it?s your true twin, we also know that people who haven?t experienced this have absolutely no clue. Sorry I am rambling.

What we must do for ourselves before our twin soul relationship can work we need to get rid of any insecurities, doubt and bitterness we might harbour. These things don?t obstruct normal relationships because we are not as afraid of screwing it up and being told that we are no longer loved. There?s nothing more mysterious to it than that. The twin soul connection will freak out even the most confident of us, and put us face to face with our own failures. We must work on our self-esteem, to learn exactly what is keeping us from either giving love or accepting love. Please note that if one of you is perfectly fine with who they are, the other one will have SO MUCH EASIER TIME accepting your relationship even if they hadn?t worked on their issues yet. This happens, because a person who is happy within themselves will never have to retort. They can take rejection, blow ups, fuck ups and all the fury of Hell from their twin flame and not blink, and unless the twin soul is absolutely torn to pieces by their personal experiences, this is usually enough to keep them together and the hurting twin will be able to heal themselves with the help of the whole one.

To fast track your own healing, it would be a great idea to seek counselling from a relationship life coach or a psychologist. These are very practical solutions to what seems to be a mysterious problem but really isn?t. Remember that all-consuming love is not the privilege of only those who hold new age beliefs. There is also nothing telling that you shouldn?t seek couple?s therapy if you are struggling to hold onto each other.

For the cheap, ;) the DYI folk and those who like things mysterious, you need to be very courageous in looking into your own psyche and finding out your own issues for yourself. I would highly recommend you contacting your soul and ask help in clearing out your internal drama. If you ask this, remember that the answers you hear will be what you NEED to hear, not what you want to hear, and even if it didn?t make sense, keep going and TRY to make sense out of it. I would suggest the pendulum for this as a tool.
